ARTICLE 1. INFORMATION WE COLLECT

1.1. Nextep recognizes that your privacy is very important and we take it seriously. This Privacy Policy (the "Privacy Policy") describes how Lokomotif Software A.Ş. ("Nextep," "we," "our," or "us") collect, use, and share information in connection with your use of our websites, services, and mobile applications (collectively, the "Services").

1.3. We collect and receive information about Nextep users from various sources, including Nextep App and information you provide through your Nextep App account.


ARTICLE 2. INFORMATION WE COLLECT WHEN YOU USE OUR SERVICES

2.1. Nextep analyzes your iPhone’s built-in pedometer data to generate visual graphs and to calculate your daily burned calories. In no case is your personal data ever transferred to a third party. It is exclusively stored on your device within the application container of Nextep.

2.2. If you choose to have Nextep integrate with Apple Health or Google Fit , the app will have access only to the health data types you opt-in to Access. HealthKit and Google Fit are activity data handling services provided by Apple Inc. And Google Inc. that enables you to access or store activity data.
2.3. The data read from Apple Health or Google Fit is used for visualizing your data within the app. It is not collected or disclosed outside of your local installation of the app.
2.4. We also collect data about the device you are using to access our Services. This data may include; the device ID and type, operating system, unique device identifiers, device settings, geo-location data, hardware and software information such as IP address, device-specific and apps setting, app crashes, app version, app name, type of user (pro/free), browser type, version and language, operating system, time zones, identifiers associated with cookies or other technologies that may uniquely identify your device or browser (e.g., IMEI/UDID and MAC address), information on your wireless and mobile network connection, like your service provider and signal strength.


ARTICLE 3. INFORMATION YOU PROVIDE

3.1. We may ask for personal information, such as your name, email address, birth date, gender, height, weight.

3.2. This data is considered “identifying information”, as it can personally identify you. We only request personal information relevant to providing you with a service, and only use it to help provide or improve this service.


ARTICLE 4. HOW WE COLLECT INFORMATION

4.1. We collect information by fair and lawful means, with your knowledge and consent. We also let you know why we’re collecting it and how it will be used. You are free to refuse our request for this information, with the understanding that we may be unable to provide you with some of your desired services without it.

ARTICLE 5. USE OF INFORMATION

5.1. We may use a combination of identifying and non-identifying information to understand who our users, how they use our services (such as frequency, duration of usage, app crashes, features you've been using, advertising that you click on), and how we may improve their experience of our Services in the future. We do not disclose the specifics of this information publicly, but may share aggregated and anonymized versions of this information, for example, in website and customer usage trend reports.

5.2. We may use your personal details to contact you with updates about our Services, along with promotional content that we believe may be of interest to you.

5.3. The processing of your personal data takes place in compliance with the General Data Protection Regulation (“GDPR”). We do not share any personal or Apple Health Kit / Google Fit data.


ARTICLE 6. USE OF E-MAIL INFORMATION

6.1. The only situation we may get access to your personal identifiable information (PII) is when you personally decide to email us your feedback or to provide us with a bug report. The PII we may get from you in that situation are strictly limited to your name, email address and the contents of your response only. In above situation, we guarantee that your PII will only be used for contacting you and improving our services. We will never use such information (e.g. your name and email address) for any other purposes, such as to further market our products, or to disclose your personal information to a third party for commercial gains.

ARTICLE 7. ADS IN NEXTEP

7.1. Nextep displays ads within app. These ads are served by third-party ad networks (AppLovin, Google, PubNative etc). Nextep Pro members are not shown any ads.

7.2. To serve ads, we or this third party ad networks do so through a mobile "SDK." The SDK is a bit of computer code that app developers can include in their apps to enable data to be collected and ads to be shown. We may use this and similar technology to deliver certain advertising through mobile applications and browsers based on data associated with your mobile device, and we may work with third parties who likewise embed their SDKs into our services, for third party advertising. If you'd like to opt-out from having ads tailored to you in this way on your mobile device, please follow the instructions below.

7.3. If you wish to opt out of interest-based cross-application tracking through your mobile device, you can do so through your device "settings", as follows (but please note that the below is for informational purposes only and Apple, Google, or other device platforms may change the manner in which their "opt out" settings work at any time): Please note that if you opt out through these settings, you will continue to receive advertising after you opt-out, but it may not be tailored to your interests. For instance, that advertising may be based on your real-time or "contextual" application usage or general location inferred from IP address.


ARTICLE 8. DATA PROCESSING – STORAGE AND SAFETY

8.1. We only retain personal information for as long as necessary to provide a service, or to improve our services in future. While we retain this data, we will protect it within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use, or modification. That said, we advise that no method of electronic transmission or storage is 100% secure, and cannot guarantee absolute data security.

8.2. If you request your personal information be deleted, or where your personal information becomes no longer relevant to our operations, we will erase it from our system within a reasonable timeframe.


ARTICLE 9. YOUR RIGHTS AND RESPONSIBLITIES

9.1. As our user, you have the right to be informed about how your data is collected and used. You are entitled to know what data we collect about you, and how it is processed. You are entitled to correct and update any personal information about you, and to request this information be deleted. You may amend or remove your account information at any time, using the tools provided in your Nextep application.

9.2. You are entitled to restrict or object to our use of your data, while retaining the right to use your personal information for your own purposes. You have the right to opt out of data about you being used in decisions based solely on automated processing.


ARTICLE 10. CHILDREN'S PRIVACY

10.1. Our services are intended for general audiences over the age of 13 years old (or over the age of 16 if you are resident in the EEA). We do not knowingly collect information from children under the age of 13 years old, or 16 years old in the EEA. If you are not over 13 years old (or 16 years old in the EEA) then DO NOT DOWNLOAD OR USE THE SERVICES.

ARTICLE 11. GENERAL

11.1. You may not transfer any of your rights under this privacy policy to any other person. We may transfer our rights under this privacy policy where we reasonably believe your rights will not be affected.

11.2. If any court or competent authority finds that any provision of this privacy policy (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this privacy policy will not be affected.

11.3. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

11.4. This Agreement will be governed by and interpreted according to the law of Turkey. All disputes arising under the Agreement will be subject to the exclusive jurisdiction of the Turkish courts.


ARTICLE 12. CHANGES TO THIS PRIVACY POLICY

12.1. Nextep reserves the right to change this privacy policy as we may deem necessary from time to time or as may be required by law. Any changes will be immediately posted on the Application and you are deemed to have accepted the terms of the privacy policy on your first use of the Application following the alterations.
